LOSFONDOS GmbH is committed to protecting your privacy and processing personal data responsibly. This Privacy Policy explains how we collect, use, store, and share personal data when you use our website and services. Data processing is based on the necessity to fulfill our contracts or on our legitimate interests.

2. Data We Collect

When you use our services, we process the following categories of data:

  • Personal Data: Name, email address, phone number, and billing or delivery address provided during registration or ordering. This includes IMEI, serial numbers, images/photos of items, user-uploaded background images for digital QR codes, descriptions, as well as digital and physical QR codes.
  • Payment Data: Information necessary for payment processing (e.g. payment status). Payment details such as credit card data are processed exclusively by the certified third party provider Stripe Payments Europe Ltd. (Ireland / USA). LOSFONDOS GmbH does not have access to full payment details.
  • QR Code Content & Communication: Text, information, and messages voluntarily provided for QR code creation or for anonymous communication between finder and owner (including instant messaging logs, for the content of which LOSFONDOS GmbH disclaims liability).
  • Technical Data: Automatically collected data such as IP address, browser type, device information, date and time of access, and cookies.

3. Use of Your Data

Personal data is processed based on Art. 6 (1) (b) and (f) GDPR for the following purposes:

  • Creating, generating, and providing digital and physical QR codes (performance of contract)
  • Processing and fulfilling orders, including shipping and payments (performance of contract)
  • Enabling anonymous communication between item owners and finders. LOSFONDOS GmbH acts as a purely technical intermediary and assumes no liability for instant messaging contents (performance of contract)
  • Analyzing and improving our website and services (legitimate interest)
  • Complying with legal obligations and responding to lawful requests (legal obligation)

4. Data Sharing

Personal data may be disclosed only in the following cases:

  • Service Providers: Third parties supporting payment processing (Stripe), shipping, hosting in Switzerland, or support. For international data transfers, an adequate level of data protection is ensured via Standard Contractual Clauses (SCCs).
  • Legal Requirements: Where required by Swiss law or lawful authority requests
  • Consent: Where you have explicitly agreed to data sharing

We do not sell or rent personal data to third parties.

5. Data Retention

Personal data is retained only for as long as necessary for the stated purposes or as required by law (e.g., 10 years for corporate records under Swiss law). QR code content may be stored to ensure functionality and can be deleted or anonymized upon justified request. Instant messaging logs are automatically deleted after the case is closed.

6. Your Rights

Under applicable data protection law, you have the right to:

  • Access your personal data
  • Rectify inaccurate or incomplete data
  • Request deletion of personal data, where legally permissible
  • Object to certain processing activities
  • Request data portability, where technically feasible
  • Lodge a complaint with a competent supervisory authority (such as the FDPIC in Switzerland)

7. Data Security

We implement appropriate technical and organizational measures to protect personal data against unauthorized access, loss, or misuse. However, no method of transmission or storage can guarantee absolute security.

8. International Users

While LOSFONDOS GmbH complies with Swiss data protection laws, the Swiss level of data protection is officially recognized as adequate by the European Commission. Users are responsible for ensuring that their use of the services complies with the laws applicable in their respective jurisdictions.
